TERMS OF SERVICEYou are expected to first read my TOS and understand my general Commission Prices.Please only participate in a transaction with me if you are an adult, 18 years of age or older, and have a PayPal account that allows you to pay yourself.By commissioning me, you agreed to my terms of service.You may display my work on external sites as long as it is visibly credited and linked back to me. You must provide proper credit wherever you use the artwork.You may not upload or host my work in any gallery that is intended to display your own work only.You may not claim my work as your own.NFT usage is strictly forbiddenMy art may NOT be used for AI purposes or anything alike. Please do not upload it to any AI sites, do not upload to DeviantArt.Please only upload the smaller file publicly unless otherwise discussed.You may use the artwork in any commercial use, cost is included in total commission price.You are NOT authorized to heavily change, modify, edit or use my works without my permission.You are NOT authorized to trace over my Artwork in any way, including the use of the artwork as a “base.”Any harassment in an attempt to bargain for a commission (a ‘slot’) is not tolerated. This includes inappropriately worded comments on my profile, as well as private messages. I reserve the right to place anyone on the blacklist over harassment.Clients who have commissioned and/or received work before this TOS has gone into effect are still bound to its contents.By commissioning me, you agree to these terms and conditions. Please read these terms carefully.



Personal Information and Confidentiality:I acknowledge and agree that any sensitive personal and business information supplied by you shall be considered confidential information and shall not be disclosed to the public by myself. All parties will hold and maintain all Confidential Information of the disclosing parties and will only be recorded for legal and archival purposes.Project Sharing: I reserve the right to share work in progress updates as well as the deliverables of the project via social media, streaming platforms and portfolio, unless a Non-Disclosure Agreement (NDA) is enforced.• Non-Disclosure Agreement (NDA): Should you request for strict confidentiality for all work in progress and deliverables of the project, you will be charged an additional NDA fee of 15% of the total payment for the project. The NDA will be concluded upon first disclosure of the deliverables to the public by the client, and I will be given the right to promote deliverables without conflict of interest from you.



Waitlist: (I currently do not have a waitlist so these do not apply)If I have a waitlist open, you may request to be added to it by sending me a message on discord or X, and you will be added to the queue. When slots open for commission, projects will be selected depending on their position in the queue. No preference will be given for total price or type of commission. Once it is your turn to take a slot, I will communicate with you via your preferred method and you will then have 24hours to finalize a commission. After that the slot will fall away to the next person in the queue.

Commission type: Illustration, emotes, shimeji, reference sheets. Character name, character personality, references. Please DO NOT send only written descriptions.Commissions are taken on a first come first serve basis.I have the right to decline your commission if I am unable to draw itDeadlines need to be discussed prior to me accepting the commission so that I can decide if I will be able to finish it in time according to expectations. The approximate ETA is dependent on each artwork and my current workload, please remember I also work a full time job. If there is a need for a rush order, additional costs will apply.Once invoices have been sent, payment must be submitted within 3 days. The commission will be cancelled should the payment not be made by the date specified unless other arrangements have been made. A copy of these TOS will be sent with the Invoice and you will be required to sign and send a signed copy back to me before I begin any work.All payments are to be 50% upfront in USD via Paypal. I will only start the commission once payment is receivedOther alternative payment plans can be discussed but at the sole discretion of myself and are not available to first time clients.


During CommissionCommunication will be via Discord.You must remain available and communicative to ensure that progress can be continuously made till the delivery date. Should you not communicate without valid reason for more than 7 days, I will be forced to put the piece on hold until communication is restored and I cannot be held liable for the commission taking longer than expected. In this case I also have the right to leave the piece on hold until such a time as I have no other priorities and can finish it. I reserve the right to terminate the project should there continue to be no response for 14 days. In this case a 50% (of what has already been paid) refund will be given.Feel free to ask for progress updates. You also always can check the progress and your position in queue on my Trello. The link will be sent to you once I start working on your commission.Please take into consideration that I may not respond immediately. Please allow a response time of 1-3 working days.Major revisions are allowed during the sketch phase, after that three free rounds of minor revisions per individual service. You will be responsible for making additional payments for major revisions.I reserve the right to stream my WIP on streaming platforms such as Twitch, Youtube and TikTok unless confidentiality is requested.


Post CommissionYou must properly identify me as the creator of the commission (by crediting Wisteria in social media descriptions).I may publish commissioned pieces in my personal portfolio, social media, or other publication media unless confidentiality is requested beforehand for a certain period of time.The commission will be marked completed 7 days after the mutual approval of the final delivery (unless the project involves an on-going project/relationship e.g. vtuber models). Any additional changes requested after the project is closed will be considered on a case by case basis.All commission prices include commercial use.


Cancellation and Refunds


Cancellation:We both reserve the right to terminate this agreement at any time by sending written notice thereof to the respective party.


If you are the one cancelling the commission, the following refund terms apply:Not started: If I have not begun the project, I will provide a full refund minus any transactions fee. Proof will be given of said transaction fees.Initial Sketches Phase: If I have started or completed the sketch phase, a 50% refund of the 50% initial payment (25% of total cost) will be given, minus any transaction fees. Proof will be given of said transaction fees. No WIP sketches will be handed over to you. I retain the right to use any work made for portfolio or repurposing.Lineart and Colour Phase/Completed: If I have started or completed the lineart and colour phase or completed the full commission, no refund of the 50% initial payment* will be given. No files of any completed work up until this time will be handed over to you. I retain the right to use any work made for portfolio or repurposing. Unless you can prove extenuating circumstances as a reason for cancellation at this point, you will also be added to a public Blacklist in my Discord Server and I will refuse to accept any commissions from you in the future. You will also be blacklisted if you chargeback.


If you are unsatisfied with the final product:
NO REFUND WILL BE GIVEN. If you have paid the 50% deposit, I have completed work and you are unsatisfied with the final product, you will not be charged the remaining 50%, you will not receive a refund on the deposit and you will NOT receive any of the completed materials. You are expected to keep up communication during the process and let me know if there are any changes I should make. You are expected to be aware of my art style and level of skill before commissioning me, I cannot be held liable for dissatisfaction that is not a result of my own negligence. I retain the right to use any work made for portfolio or repurposing.


If I am the one who cancels the commission: If, for any reason, under extenuating circumstances, I have to cancel the commission, a full refund of any paid monies will be refunded, regardless of the progress of the commission, and all files will be handed over to you.


If you violate and of the Terms of Service I reserve the right to cancel the commission without refund and refuse service in the future. No files of any completed work up until this time will be handed over to you. I retain the right to use any work made for portfolio or repurposing. You will also be added to a public Blacklist in my Discord Server and I will refuse to accept any commissions from you in the future. You will also be blacklisted if you chargeback.
